A sample question
Lars is the sole registered proprietor of the family home. His wife, Mira, has no beneficial interest in it but lives there with him. Nothing is entered on the register. Lars sells the house to a buyer, who completes and registers the transfer. Mira claims the buyer must let her stay. What is the position?
- She is protected because she was in actual occupation at completion
- Her home rights do not bind the buyer, as no notice protected them
- She is protected because her home rights arise automatically and bind everyone
- She is protected because the sale needed her written consent as a spouse
- She is protected because she could have registered a Class F land charge
