SQE1 FLK1 practice set 5

Forty-five single-best-answer questions from the FLK1 subjects: Business Law and Practice, Dispute Resolution, Contract, Tort, the Legal System of England and Wales, Constitutional and Administrative Law and EU Law, and Legal Services, with ethics and professional conduct woven through. Each question has five options and one best answer. This is one quarter of an FLK paper. From January 2027 each FLK assessment has 170 questions in two sessions of 85, each lasting 2 hours 33 minutes. This set is timed at the January 2027 pace of 1 minute 48 seconds a question (81 minutes for 45 questions). There is no fixed pass mark: the SRA sets it separately for each paper at each sitting and reports it on a scaled score where 300 out of 500 is a pass, so this set gives you a percentage and a subject breakdown, not a pass or fail. The law is stated as it stood in England and Wales on 1 September 2026 (the SRA assesses the law as it stands four calendar months before the first assessment in a window).

A sample question

A fishing company charters a trawler that can only be used with an official licence. It operates five trawlers and applies for licences for all five, but is granted only three. It chooses to allocate them to its own three boats and tells the owner of the chartered trawler that the charter is frustrated. Which statement best describes the position?

  • The charter is frustrated, because the licensing decision was made by a third party outside the company's control.
  • The charter is frustrated, because performance without a licence would be illegal and so impossible.
  • The charter is frustrated only as to future hire, with the earlier payments adjusted under the 1943 Act.
  • The charter is not frustrated, because the failure to perform resulted from the company's own choice.
  • The charter is not frustrated, because the shortage of licences was a commercial risk of higher cost only.
